The Victorian Labour Hire Licensing Scheme is a new business licensing system that protects vulnerable labour hire workers from exploitation and regulates the provision of labour hire services. The licensing scheme commenced on 29 April 2019 with a six-month transition period meaning that from 30 October, no person or organisation would be able to provide labour hire unless they either hold the license or have at least applied it and not refused.
Highlights of the licensing scheme
- Anyone supplying labour to another person or organisation are covered.
- Application for license must be lodged using LHLO portal
- The application is quite extensive and will require lot of information to be submitted
- While applying, there is fee to be paid based on turnover after which license renewal needs to be paid every year
- Information about workers visa needs to be included in the application
- Number of workers provided to the host (where labour hire is provided for example farms) in the last 12 months or expected to be provided in the next 12 months in case of new labour hire provider
- Information about transport and accommodation services if provided to workers
- The industry to which the labour hire provider will provide labour
- Fit & proper person test for the applicant
- Compliance with other laws including taxation, superannuation, work place and migration etc.
